Class action lawsuit filed against Wynn Resorts for data leakage involving 800,000 customers' personal information.

LAS VEGAS (FOX5) - A California man has filed a class action lawsuit in U.S. federal court against Wynn Resorts, alleging that the group failed to secure the personal information of more than 800,000 customers in a data breach earlier this month.

The lawsuit, filed on Feb. 21, alleges that the hacker group ShinyHunters announced on Feb. 20 that it had stolen more than 800,000 customer records from Wynn Resorts, including names, social security numbers, dates of birth, and other sensitive, personally identifiable information.

The lawsuit alleges that Wynn stored data without encryption and failed to implement adequate cybersecurity measures, including multiple authentication and staff security training, and that its breach notification letter concealed the identity of the hacker, the cause of the incident and remedial measures. The Group's 24-month identity monitoring service for affected customers was also criticized by the litigants as insufficient.

FOX5 asked Wynn Resorts for a response, and the group said it had immediately activated its incident response mechanism and launched an investigation after discovering the network problem.

The spokesman said the unauthorized third party involved in the incident claimed to have deleted the stolen data, and there is no sign that the data has been disclosed or misused. The incident has not affected the guest experience, the Group's operations and physical facilities, and all businesses are operating as usual.

This lawsuit brings seven counts against Wynn, including negligence, statutory negligence, unjust enrichment, invasion of privacy, breach of fiduciary duty, and breach of implied contract, and seeks a declaratory judgment from the court.

The plaintiffs are seeking damages, an injunction requiring Wynn to enhance its data security systems, a mandatory annual security audit, and ongoing credit monitoring services for all class action members. As of Tuesday, the court had not scheduled a hearing.

Wynn Resorts said in a statement that the investigation is still underway and the Group is providing free credit monitoring and identity protection services to its employees, emphasizing that the security of employee and guest data is the primary concern, and is working with top IT consultants in the industry to strengthen its systems to prevent the recurrence of similar incidents.
